TERMS OF SERVICE

1. GENERAL PROVISIONS AND SERVICE PROVIDER
These Terms govern the use of the NEKTIQA SaaS service available at nektiqa.com (the Service). The Service Provider is Mikita Klimuk, conducting business registered in the Central Register and Information on Economic Activity (CEIDG). Address: UL. GEN. These Terms are made available free of charge before an agreement is concluded in a form that allows them to be obtained, reproduced, and saved.
2. DEFINITIONS
- User: a natural person, legal person, or organizational unit using the Service.
- Consumer: a natural person making a purchase not directly related to their business or professional activity.
- Customer Data: information entered into the Service, including project names, domains, URLs, release markers, and notes.
- Subscription: a paid, recurring service provided by the Service Provider.
- Account: a registered Google OAuth or verified email/password identity used to access registered features.
3. TECHNICAL REQUIREMENTS
The Service requires a device with Internet access and a current browser supporting JavaScript, HTTPS, cookies, and Web Storage (localStorage). Registered access requires an active Google account or access to a verified email address and the password assigned to that Account. Users are responsible for maintaining access to their email and protecting their credentials.
Tested URLs must be publicly accessible through HTTP or HTTPS and accessible to Google PageSpeed Insights. The Service does not support localhost, private IP addresses, or websites that require prior authentication.
Account verification, password recovery, sign-in-method notices, and complaint responses may be delivered electronically to the supplied email address. Delivery depends on the User providing a valid address and maintaining the ability to receive messages.
4. SCOPE OF THE SERVICE
The Service includes:
- Public Test: a one-off website performance analysis available without registration, subject to browser-based and server-side abuse limits.
- Dashboard: project management, test history, Core Web Vitals and other Lighthouse metrics, reports, release markers, and scheduled tests for eligible registered Users.
- Simple and Pro Subscriptions: increased project, URL, and test limits and automated testing schedules. Current plan features and limits are shown on the pricing and account pages.
- Complimentary Simple Access: may be granted for one to six months. It does not renew automatically, may be restricted to a specific email, may be revoked, and can be redeemed only once per Account subject to eligibility.
Results depend on third-party PageSpeed Insights measurements and conditions at the time of each test. They are informational and do not guarantee a particular search ranking, accessibility level, legal compliance, or business result.
For authenticated tests, the full technical report is normally available for up to 30 days and the compact score, metric, and issue summary for up to 180 days. If a full report cannot be stored or retrieved, the Service may provide only the compact summary. The Service is not a permanent archive, and Users should retain any report they need beyond these periods.
5. ACCOUNTS AND ACCEPTABLE USE
Users must provide accurate information, keep credentials confidential, and promptly notify the Service Provider of suspected unauthorized access. A User may not create accounts or submit requests to evade limits or security controls.
Users must not:
- test websites without a lawful basis, authorization, or legitimate interest to do so;
- use the Service for attacks, security bypass, automated abuse, interference, or excessive infrastructure load;
- introduce malware or attempt to access another User's Account or data;
- place unlawful content, third-party personal data without a lawful basis, trade secrets, credentials, or access tokens in Customer Data or support messages;
- misuse complimentary invitations, payment flows, refunds, or trials.
The Service Provider may restrict or suspend access where reasonably necessary to protect the Service, comply with law, investigate abuse, or address a material breach of these Terms.
6. PAYMENTS, TRIALS, AND SUBSCRIPTIONS
- Checkout: paid subscriptions are concluded after successful Stripe Checkout. Before Checkout, the buyer selects personal (consumer) or business use. Stripe handles payment-card, billing-address, and applicable tax-ID data.
- Optional Simple trial: an eligible customer may explicitly choose one 7-day Simple trial. It requires a payment method and includes 1 project, 3 URLs per project, 100 tests in total, and Simple automatic schedules. Unless canceled before the end of the trial, it converts to a monthly Simple subscription.
- Paid plans: Simple and Pro subscriptions start immediately after successful payment, are billed monthly, and renew automatically until canceled.
- Cancellation: Users can cancel through the Stripe Customer Portal. Except when a Consumer exercises the withdrawal flow below, paid access continues until the end of the current billing period.
- Plan limits: tests, projects, URLs, and schedule intervals are subject to the limits displayed for the selected plan. Failed or retried tests may consume provider and Service capacity as described in the interface.
Prices, taxes, and the amount due are displayed in Stripe Checkout before purchase. Invoices and receipts are made available through Stripe.
7. CONSUMER RIGHT OF WITHDRAWAL
A User who purchased for personal purposes as a Consumer may withdraw within 14 calendar days from the initial paid subscription invoice using the Billing page or by contacting support. Where the withdrawal applies, the subscription is cancelled and the applicable refund is processed.
This self-service statutory withdrawal flow is not available for purchases classified as business or professional use. Mandatory consumer rights remain unaffected by these Terms.
8. CUSTOMER DATA AND INTELLECTUAL PROPERTY
The User retains rights to Customer Data and grants the Service Provider a limited right to process it only as necessary to provide, secure, and maintain the Service. The User is responsible for Customer Data and for having the rights needed to submit and test it.
The Service is intended only for testing publicly available pages. It is not offered as a personal-data processing service on a User's behalf, and no Article 28 GDPR data-processing agreement is currently available. The User must not submit personal data for processing through the Service or use it to test restricted, account-specific, or otherwise non-public pages.
The Service, source code, design, algorithms, trademarks, and Service Provider content remain the property of the Service Provider or the relevant licensors. The User receives a limited, non-exclusive, non-transferable, and revocable right to use the Service in accordance with these Terms for the duration of the applicable access.
9. AVAILABILITY AND LIABILITY
The Service is provided on an “as is” and “as available” basis. The Service Provider does not guarantee uninterrupted availability or specific business results and is not responsible for interruptions caused by third-party providers or other events outside reasonable control.
To the fullest extent permitted by law, liability to Users who are not Consumers is limited to the amount paid for the most recent subscription period. Nothing in these Terms excludes liability that cannot legally be excluded or limits mandatory Consumer protections.
10. COMPLAINTS AND SUPPORT
Support requests and complaints may be submitted through the support form or to support@nektiqa.com. A formal complaint should include the Account email, a description of the issue, the date of occurrence, and any reference needed to identify the affected transaction or test. Do not include passwords, access tokens, payment-card data, or unnecessary third-party personal data.
The Service Provider will respond to a formal complaint within 14 days to the supplied email address. Ordinary support questions are handled as soon as reasonably practicable.
11. ACCOUNT DELETION AND DATA EXPORT
A User may request a copy of available Account, project, and test data in JSON format by contacting support@nektiqa.com. Account deletion takes effect after a 14-day grace period. After that period, Account and Service data is deleted, except for records that must be retained under applicable law. Details are set out in the Privacy Policy.
12. FINAL PROVISIONS
These Terms are governed by Polish law. Disputes are subject to the competent Polish common courts, unless mandatory consumer rules provide otherwise. The Service Provider may update these Terms for legal, security, provider, or functional changes; the current version and effective date will be published on this page.
If the translated versions differ, the Polish version prevails, without limiting rights that cannot be waived under applicable law.
